$500,000 settlement result for gas station fall
Robert Sappe recently negotiated a $500,000 settlement result for a 74 year old man from Fishkill, NY who sustained injuries to his knees and shoulder as the result of a fall at a local gas station. As the client was walking into the station to pay for the gas that he had just pumped, he twisted his ankle and fell when he stepped on section of heaving concrete near the entrance to the gas station office. The evidence showed that the gas station owner was aware of the problem with the heaving concrete for a number of years but took no measures to correct it or warn his customers. As a result of the fall, the client injured his knees and underwent bilateral arthroscopy to repair torn meniscii in both knees. He continued to experience pain, weakness and buckling of the knees and then underwent bilateral knee replacements. Also, as the result of one episode of buckling, he fell and fractured his right dominant arm, and may need future shoulder surgery.
