Feldman, Kleidman, Collins & Sappe LLP’s (FKC&S) 33-year-old client was riding his motorcycle in Wappingers Falls, NY, near Dutchess County Airport. An ambulance (not responding to an emergency call) made a left turn directly in front of FKC&S’s client. As a result, he had to lay down his bike, and went skidding down the road. He suffered a right shoulder injury requiring surgery, followed by another surgery to correct a nerve issue.
FKC&S’s Steven H. Cohen made a motion for summary judgment arguing that the accident was 100 percent the fault of the ambulance, which was granted. The defense then argued that not all of FKC&S’s client’s injuries were due to this accident. As often occurs on the eve of trial, more productive negotiations occurred, resulting in a $250,000 settlement just prior to the scheduled trial in January 2023.
