On the morning of February 25, 2022, Feldman, Kleidman, Collins & Sappe LLP’s (FKC&S) client, a 56-year-old resident of Mohegan Lake, NY, was heading southbound on the Taconic State Parkway in Yorktown Heights, NY. He was on his way to work as a set decorator/dresser (he builds and breaks down movie and TV sets) in the Bronx. It was snowing at the time and the roads were just being plowed.
FKC&S’s client was in the right lane when another driver in the left lane lost control and struck the rear of his car on the driver’s side, pushing him off the road and totaling his car. As a result, FKC&S’s client suffered herniated discs in his neck and a tear in his left shoulder, which required surgery and kept him out of work for months.
The case was placed into suit and, after all parties gave deposition testimony, Steven H. Cohen recovered the full policy limit of $100,000 for FKC&S’s client. Ultimately, the insurance company was concerned that if the case went to trial there could be a verdict in excess of policy limits, so they settled to protect their insured’s interest.
