In September 2015, a 50 year old woman was walking along a sidewalk in the Village of Nyack. She was caused to trip and fall on a hole in the sidewalk. She suffered a dislocated right shoulder, torn rotator cuff and torn labrum, which required surgical repair. We were retained 3 months after the fall. There was no prior written notice to the Village about the defective sidewalk, but we found a provision in the Village Code that transferred responsibility for the sidewalk to the abutting landowners, which in this case was the United States Postal Service. We filed a claim with the USPS, who agreed to settle before suit was filed for $125,000.
