Our client, a 65 year old gentleman, was involved in a stair accident while catching a train to NYC. He parked and went into the underground tunnel to get to the southbound platform. As he was going up the stairs from the tunnel, he tripped and fell because the nose of the stair treads were worn and uneven. As a result of this stair accident he suffered a fracture of his upper jaw, which healed without any surgery. The defendant claimed the stairs were safe and our client was running, claiming that’s why he tripped. Based upon scene photos taken shortly after the fall, the case was settled before any lawsuit was even filed.
