Jeff Feldman successfully defended an interventional cardiologist and an internist in a case involving the alleged negligent failure to diagnose a known reaction to a statin medication. Plaintiff had an inferior wall MI, which led to a stent being placed and the patient being prescribed Simvastatin(Zocor generic) 80mgs. Plaintiff claimed that over the ensuing few months that he complained to both physicians about muscle aches and cramps. Both physicians denied that plaintiff ever made any such complaints. The jury unanimously found that as documented by the physicians records that they each inquired as to muscle issues, that plaintiff denied any muscle issues and that at the first hint of a muscle issue that plaintiff was immediately taken off of the statin.
