In January 2023, Feldman, Kleidman, Collins & Sappe LLP’s (FKC&S) 55-year-old client, a self-employed contractor from Stormville, NY, was driving on New York State Route 52 in the snow. The defendant driver lost control and crossed into FKC&S’s client’s lane, causing a crash. FKC&S’s client suffered a left arm fracture which required surgery and hardware. He developed an infection which required hospitalization to address.
The defense argued that their client was faced with an emergency (weather) and was not at fault. They also argued that FKC&S’s client did not follow his doctor’s instructions, allegedly leading to the infection. The case was placed into suit and depositions were held. The defense had FKC&S’s client examined by their doctor, who said that he is now perfectly fine. The matter ultimately settled for $225,000 just before trial.
