Feldman, Kleidman, Coffey and Sappe LLP’s (FKC&S) 52-year-old client from Wingdale, NY serves as a traveling special education teacher. In February 2020, she was at a nursery school site at a community college in Dutchess County. As she walked out of the building to the parking lot, she encountered uneven pavement, which was difficult to appreciate due to shadows from the overhead trees. She stumbled and fell, sustaining a right wrist fracture and right shoulder injury, resulting in multiple surgeries. She was out of work for one month. The defense argued she had walked there before, and that any unevenness was open and obvious to everyone. The case was placed into suit and after depositions, was settled for $300,000.00.
