Feldman, Kleidman, Collins & Sappe LLP’s (FKC&S) 48-year-old client, a cellular field technician from New Windsor, NY, was rear-ended on Windsor Highway on October 27, 2019. He suffered an injury to his left shoulder, requiring arthroscopic surgery in 2020. Unfortunately, he had prior injuries to both shoulders and a prior MRI showed a tear existed before this crash. The defendant’s insurance company refused to make any offers and claimed that all his injuries pre-existed this accident.
FKC&S put the case into suit, took depositions and had a trial date set by the court. In a report, FKC&S’s client’s doctor opined that this crash worsened his prior shoulder tear, necessitating surgery. FKC&S’s client was out of work for 12 days after the crash and then for a few months following the surgery. The insurance carrier finally tendered all available insurance a few months before the trial date.
FKC&S is now working on a supplementary underinsurance claim (SUM) with the client’s own carrier to secure further compensation for his pain and suffering. SUM, which you may carry yourself, provides money for pain and suffering beyond the limits of the careless driver’s insurance coverage.
