William (Bill) T. Collins, III won summary judgment dismissing all claims of medical negligence on behalf of Feldman, Kleidman, Collins & Sappe LLP’s (FKC&S) client, a maternal fetal medicine specialist, in a Westchester County, NY case.
The plaintiffs claimed that FKC&S’s client, who was monitoring the patient’s placenta previa, failed to recommend a cesarian section delivery several weeks before her actual due date. Consequently, it was alleged that the infant suffered global developmental delays, brain damage, motor delays and a plethora of other injuries.
In establishing entitlement to dismissal of the claim, Bill successfully argued in the motion that FKC&S’s client’s role was as a consultant to the patient’s obstetrician; that the client properly interpreted prenatal ultrasounds; and FKC&S’s clients did not have a role in determining when to deliver the infant, as that was the responsibility of the patient’s obstetricians.
